Messaging Terms and Conditions

These Messaging Terms and Conditions (“Terms”) govern your use of the messaging services provided by the SailTime Group, LLC (“Company,” “we,” “our,” or “us”). By using our messaging services, you agree to comply with and be bound by these Terms.

1. Acceptance of Terms

By agreeing to interact with our messaging services, you accept and agree to these Terms, which may be updated or amended from time to time at the Company’s sole discretion. We will notify you of any significant changes to these Terms.

2. Messaging Services

Our messaging services may include SMS, email, push notifications, or other forms of communication as determined by us. These services may be used to provide information, alerts, updates, and other communications related to our products or services. Standard message and data rates may apply depending on your carrier and mobile plan. You are responsible for any charges that your mobile carrier may impose for receiving or sending messages.

3. Opting In

To receive messages from us, you must opt in by providing your consent. Consent is considered given by checking the box on the webform that states “Yes, I agree to receive text messages by The SailTime Group, LLC”. Once consent is given, you may Opt Out at any time using the “Opting Out” instructions in #4  below.

4. Opting Out

You may opt out of receiving messages at any time. To opt-out of SMS messages, reply “STOP” to the message you received. For email communications, use the “unsubscribe” link provided in the email. Upon opting out, we will cease sending further messages unless required by law or for essential service-related communications.

6. Message Frequency

The frequency of messages may vary depending on the service to which you have subscribed.

7. Content of Messages

We reserve the right to send messages that contain information about our products, services, or other communications related to our business. We will not send any illegal, obscene, or otherwise inappropriate content through our messaging services.

8. Privacy

We do not sell or share mobile opt-in data or consent with third parties for marketing or promotional purposes. By engaging with our services, you consent to our collection and use, and sharing of your data as described in the Privacy Policy, which can be found here  https://sailtime.com/privacy/.  Mobile opt-in and consent are excluded from any sharing mentioned in the policy; opt-in information is never shared.

9. No Warranty

We do not guarantee the availability, accuracy, or timeliness of the messages sent through our messaging services. We are not responsible for any delays, errors, or failures in the delivery of messages.

10. Limitation of Liability

To the fullest extent permitted by law, SailTime Group, LLC shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of our messaging services.

11. Governing Law

These Terms are governed by the laws of the State of Maryland without regard to its conflict of law principles. Any disputes related to these Terms will be resolved in the local courts of the Company’s location.
